1. Acceptance of Terms
By registering and using the WhatsApp CRM platform (“Service”) provided by First Choice IT Solutions, you agree to comply with and be legally bound by these Terms and Conditions. If you do not agree, you must not use the Service.
2. Description of Service
The Service provides a cloud-based CRM integrated with WhatsApp Cloud API to enable businesses to:
Send and receive WhatsApp messages
Manage customer interactions
Automate workflows and notifications
Integrate with third-party platforms (e.g., WooCommerce)
3. User Responsibilities
You agree that you will:
Use the platform only for lawful business purposes
Comply with all applicable laws and regulations, including data protection and privacy laws
Follow WhatsApp Business policies provided by Meta Platforms, Inc.
Obtain proper user consent before sending messages
You shall NOT:
Send spam, unsolicited, or bulk messages without consent
Use the platform for fraud, phishing, or misleading communications
Violate WhatsApp Commerce or Messaging policies
4. WhatsApp Compliance
You acknowledge that:
This platform uses WhatsApp Cloud API provided by Meta
Your use is subject to WhatsApp Business Policy and Meta Platform Terms
Meta may restrict or disable your number if policies are violated
First Choice IT Solutions is not responsible for WhatsApp account bans or restrictions
5. Data Usage & Responsibility
You are solely responsible for the data you collect, store, and process
You must ensure customer consent before storing or messaging users
You agree not to store sensitive personal data without proper safeguards
6. Account Security
You are responsible for maintaining login credentials
Any activity under your account is your responsibility
You must notify us immediately in case of unauthorized access
7. Subscription & Payments
Services may be offered on subscription or usage-based pricing
Failure to pay may result in suspension or termination
Fees are non-refundable unless explicitly stated
8. Service Availability
We aim for high uptime but do not guarantee uninterrupted service. Downtime may occur due to:
Maintenance
Third-party outages (e.g., Meta APIs)
9. Limitation of Liability
First Choice IT Solutions shall not be liable for:
Loss of business, data, or profits
WhatsApp number bans or API restrictions
Third-party service failures
10. Termination
We reserve the right to:
Suspend or terminate accounts violating policies
Remove access without prior notice in case of abuse
11. Modifications
We may update these Terms at any time. Continued use constitutes acceptance.
